Department of business economics, Delhi University, (hereinafter referred as “Alumni.dbe- du.org” which expression shall, unless repugnant to the context or meaning thereof, be deemed to include its affiliates, parent company, legal representatives and permitted assigns) provides you, i.e. the User (hereinafter referred to as the “User”) with access to its content, resources, tools for communication, public forums, commerce platforms, and other services through Alumni.dbe-du.org (hereinafter referred to as the “Service").
The Terms of Service contained in this document govern the Service and its usage by the User and at all times these Terms of Service shall refer to include all amendments, related policies, operating rules, etc., as may be published by Alumni.dbe-du.org on Alumni.dbe- du.org
1. ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE
The Service is provided to the User, subject to these Terms of Service which comprise the entire agreement between the User and Alumni.dbe-du.org. BY COMPLETING THE REGISTRATION PROCESS/CLICKING THE "SUBMIT" BUTTON/USING THE SERVICE, USER UNEQUIVOCABLY AGREES TO BE BOUND BY THE TERMS OF SERVICE, AS UPDATED FROM TIME TO TIME.
2. MODIFICATION OF THESE TERMS OF SERVICE
Alumni.dbe-du.org reserves the right to change, add or remove any of the Terms of Service at any time without prior notice, which shall become applicable immediately upon posting. User is solely responsible for regularly reviewing these Terms of Service including all changes/modifications if any incorporated by Alumni.dbe-du.org from time to time. Continued use of the Service by the User, shall constitute his/her acceptance of the amended Terms of Service.
3. MODIFICATION TO THE SERVICE
a. Alumni.dbe-du.org reserves the right to modify or discontinue, temporarily or permanently, the Service or any part of thereof, without any obligation to give any prior notice to the User. The User agrees that Alumni.dbe-du.org shall not be liable to the User or any third-party for any modification or discontinuance of the Service;
b. Alumni.dbe-du.org reserves the right to move the Content (as defined in clause 4) from one domain to another, within its Network.
4. THE SERVICE
Services offered through Alumni.dbe-du.org aim to connect the alumni of a College/university with their alma mater and/or with each other, with those from other College(s)/university(ies) and with professionals Users. This shall help in enriching the User’s social as well as professional life.
Working model of Alumni.dbe-du.org is as follows:
a. College/University (“Alma Mater”) or an alumni or an alumni group (hereinaftercollectively referred to as the “Group Founder”), as the case may be can joins Alumni.dbe- du.org.
There are different payment plans for joining Alumni.dbe-du.org and the Services available for the Alma Mater and/or its alumni, are as per the payment plan opted by the Group Founder.
Post joining Alumni.dbe-du.org, Alumni.dbe-du.org shall make a distinctive interactive group for the Group Founder on Alumni.dbe-du.org. The Group Founder can then invite its Alma Mater and other alumni to join the group by creating their log-in user id and password to make use of the Services. The alumni who have already accepted the Group Founder’s .invitation to join the group on Alumni.dbe-du.org may further invite other alumni to join the group.
b. Alumni.dbe-du.org will try on it’s end to invite more alumni & get them signed up too.
c. Depending on the payment plan opted for by Group Founder ., Alumni.dbe-du.org may customize its group, as per the requirements of the Group Founder . The payment plans and the features of such plan may change/discontinue from time to time at the sole discretion of Alumni.dbe-du.org.
d. Certain payment plans allow the group to be monitored by the designated personnel of the payee.
e. In no event shall any responsibility regarding the Content (defined hereinafter) lie on Alumni.dbe-du.org.
f. In case of access of the Content to other Users including commercial driven third party users such as recruitment agencies, other service/product providers, etc., User gives his/her/their implied and absolute permission for such access by joining the group/using the Service.
The Service may include interactive groups, directory listing of the Users, e-mail services, message boards, online chat areas, online polls, posting of jobs, posting of photographs, news groups, forums, communities and/or other message or communication facilities designed to enable you to communicate with others (hereinafter collectively referred to as the "Tools for Communication").
The contents of the Services are intended for the User’s personal use.All materials published on the Services (including, but not limited to news articles, photographs, text, images, illustrations, audio clips and video clips, hereinafter referred to as the "Content") are protected by copyright, and owned or controlled by Alumni.dbe-du.org or the party credited as the provider/owner of the Content. You shall abide by all additional copyright notices, information, or restrictions contained in any Content accessed through the Service. For more detail on the Intellectual Property Rights on the Content please refer to Section 9 herein.
We also disclaim any liability for the Content which is licensed to us by third parties and are not liable for any delays, inaccuracies, errors or omissions in any such Content, or in the transmission or delivery of all or any part thereof, or for any damages arising therefrom.
Our network of websites including Alumni.dbe-du.org and the mobile applications (if any) may contain links to other related World Wide Web Internet sites, resources, and advertisers. Since we are not responsible for the availability of these outside resources, or their contents, you should direct any concerns regarding any external link to the site administrator or webmaster of such site.
5. USER CREATED CONTENT
You as the User shall be responsible and liable for the Content posted/created by you on Alumni.dbe-du.org. The Service may include the capability to make comments, bulletin boards, discussion groups and other areas or features that allow feedback, comments and input of Content by you. While Alumni.dbe-du.org does not control the Content posted on social forums by the User, it reserves the right (which it may exercise at its sole discretion without notice) to delete, move or edit the messages, comments, etc. and to terminate User’s/s’ access to and use of the Services. Alumni.dbe-du.org reserves the right to delete, move, or edit the messages, comments, submissions, Content that it, in its sole discretion, deems abusive, defamatory, obscene, in violation of copyright or trademark laws or any other applicable laws, or otherwise unacceptable. By submitting the Content on any afore mentioned forums, User agrees to indemnify and hold harmless Alumni.dbe-du.org from all claims, costs and expenses (including legal expenses) arising out of any liability due to Content posted by the User.
By submitting Content on Alumni.dbe-du.org, the User is granting Alumni.dbe-du.org a perpetual, irrevocable, royalty free non-exclusive licence to reproduce, modify, translate, make available, distribute and sub-license the Content in whole or in part, and in any form. This may include personal information such as the User’s/s’ Registration Information and Content including expressions of opinion.
It is not possible for Alumni.dbe-du.org to fully and effectively monitor infringement of third- party rights. If the User believes that any Content infringes his/her legal rights, he/she should notify Alumni.dbe-du.org immediately using the contact address: alumnicomm@mbe-du.org
6. REGISTRATION OBLIGATIONS
(i) As a condition of use of the Service, The User shall:
a. Provide true, accurate, current and complete information about himself/herself as required by the Service's registration form (such data being the "Registration Information "). User shall be solely responsible for this Registration Information and under no condition is Alumni.dbe-du.org liable for their loss, misuse or theft;
b. Maintain and promptly update the Registration Information to keep it accurate, current and complete. If the User provides any information that is untrue, inaccurate, not current or incomplete, Alumni.dbe-du.org has the right to terminate the user account and refuse any and all current or future use of the Service;
c. Alumni.dbe-du.org reserves the right to use / disclose the aggregate Registration Information to third parties in accordance with Clause 4(g) herein;
d. As part of the subscription or usage of the Services or account creation process, User may be required create login credentials by selecting a password and providing an e-mail address. User shall be solely responsible for such login credentials and under no condition is Alumni.dbe-du.org liable for their loss, misuse or theft of the same
e. Each subscription shall be for a single User only. User is advised not to share his/her subscription details and login credentials with anyone else;
f. User shall notify Alumni.dbe-du.org vide an email to Alumni@dbe-du.org regarding any known or suspected unauthorized use(s) of his/her account/subscription, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of his/her password or credit; g. User shall follow all local applicable laws regarding age limits for subscription to the Services or any part thereof;
h. User is responsible for all usage or activity of and through his/her account on the Service, including use of the account by any third party. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of the User’s account, at Alumni.dbe-du.org’s sole discretion, and Alumni.dbe-du.org may refer you to appropriate law enforcement agencies;
i. Alumni.dbe-du.org and/or third parties may, from time to time, send email messages to Users containing advertisements, special promotions, and other marketing materials ("Email Marketing Programs") based on the agreed terms between Alumni.dbe-du.org and its selected partner(s). Alumni.dbe-du.org also offers Users permission-based email services. Users must decide to "opt-in" to our email services through a link on the Alumni.dbe-du.org site before they receive any email services, newsletters, special promotions or other marketing materials ("Opt-In Email Programs"). Alumni.dbe-du.org has the right to partner with any email marketers to provide these Email Marketing Programs or Opt-In Email Programs;
(ii) User agrees not to use the Service to:
a. Obstruct or hinder the use and enjoyment of the Service by other Users;
b. Intentionally or unintentionally violate any applicable local, state, national, and international laws and regulations; including, but not limited to, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;
c. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
d. Interfere with or disrupt the Service or servers or networks connected to the Service, or defy any requirements, regulations or guidelines of networks connected to the Service;
e. Transmit or otherwise make available any material in connection with surveys, chain letters, junk email, spamming, contests, pyramid schemes, or any duplicative or unsolicited messages (commercial or otherwise);
f. Upload, post, email, transmit or otherwise make available any content that is unlawful, damaging, intimidating, hostile, offensive, harassing, defamatory, improper, obscene, vulgar, invasive of another's privacy, caste related, ethnically or otherwise objectionable;
g. Upload, post, email, transmit or otherwise make available any content protected by any patent, trademark, copyright or other intellectual proprietary laws unless you own or control the rights thereto or have received all necessary consents to do the same;
h. Upload files that contain viruses, worms, corrupted files or any other similar software or programs designed to disrupt, damage or limit the operation of any computer or telecommunications equipment or property of another;
i. Stalk or otherwise harass other users or collect or store personal data about other Users;
j. Advertise, promote or offer to sell or buy any goods or services for any business purpose unless the Service specifically allows such messages or transactions;
k. Reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion, use or access of the Service;
l. harm minors in any way;
m. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Services or develop restricted or password-only access pages, or hidden pages or images (those not linked to from another accessible page);
n. upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
o. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other Users of the Services are able to type, or otherwise act in a manner that negatively affects other Users' ability to engage in real time exchanges;
p. promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, but is not limited to, providing instructions on how to assemble bombs, grenades and other weapons, and creating "Crush" sites.
7. TECHNICAL PROCESSING
In view of the global nature of the world wide web, the User understands and agrees that technical processing of tools of communication is (and may be) required to send and receive messages, to correspond / conform to the technical requirements of connecting networks, to correspond / conform to the limitations of the Service, or to correspond / conform to other, similar technical requirements.
8. EVENT PAYMENT TERMS
a. EVENT ORGANIZER TERMS
a.1 PAYMENT PROCESSING: By opting for payment processing, the event registration fee will be processed directly by Alumni.dbe-du.org Payment Gateway Partners. Alumni.dbe-du.org will collect the money on behalf of the organizer from each of the buyers and and will deduct Alumni.dbe-du.org service fee from the collected amount and pass rest of the money to the Organizer within 5 Business days form the end of event day by Electronic fund transfer to the given bank account.
(i) It is the responsibility of the organizer to communicate its refund policy to
Buyers via the event page. (ii) Any chargebacks initiated by the buyer with respect to an event shall be charged back to the organizer of that event. All the issues, disputes and communication regarding the chargebacks are between the buyer and the Organizer of such event. Alumni.dbe-du.org is not responsible for it. Hence, organizer is agree to fully indemnify Alumni.dbe-du.org and its associates, affiliates for any chargeback issue.
a.2 CHANGE OF EVENT: If an event for which tickets are sold or already have been sold can be cancelled or changed (regarding date, time, venue or other important points), the organizer is responsible for making all these changes.
a.3 ACCOUNTING: Alumni.dbe-du.org undertakes accounting for the organizer and holds the money on a separate bank account. The organizer authorizes Alumni.dbe-du.org to do so. Alumni.dbe-du.org transfers the money received according to service pricing minus the fees payable to Alumni.dbe-du.org within 5 working days to the organizer. The money has to be transferred to a bank account located in the country where the event took place and issued on the name of the organizer. For recurring events, Alumni.dbe-du.org reserves the right to pay out money before the event. Alumni.dbe-du.org reserves the right to change the number of days to transfer money to the event organizer at any time without notice. The organizer is aware of the risk that specific payment methods (direct debiting or credit card) can be reversed by the ticket buyers. The organizer bears this risk alone. If transactions are reversed after the payment to the organizer, these costs plus a fee for the reversed transaction charged to the organizer.
The organizer is obliged to raise objections, if any, against the accounts of Alumni.dbe-du.org within four weeks after issue of the account. If not, the account is considered as being approved.
a.4 PREVENTION AGAINST FRAUD / MISUSAGE: If the organizer arouses suspicion of misuse of Alumni.dbe-du.org services, Alumni.dbe-du.org has the right to deactivate the ticketed event of the organizer and to stop the ticket selling. In particular, a suspicion of misuse of the Alumni.dbe-du.org services is on hand, if it comes to attention before the event that the event shall not (or not in the way as stated in the ticket shop) take place; or illegal or immoral events shall take place. or If the organizer arouses suspicion of misusing of Alumni.dbe-du.org services, Alumni.dbe-du.org has the right to delay the payout to the organizer even after 5 to 7 days for further 60 days. Within these 60 days Alumni.dbe-du.org will check if animproper use of the Alumni.dbe-du.org-Websites and / or Alumni.dbe-du.org-Services occurred.
If a transaction arouses suspicious and if it is brought to Alumni.dbe-du.org's notice, Alumni.dbe-du.org reserves the right to suspend/pause/hold/cancel that transaction event without informing the organizer and organizer can't claim that money from Alumni.dbe-du.org until Alumni.dbe-du.org completes its own investigation to ensure that the transaction in question in not fraudulent.
a.5 WARRANTY OF THE ORGANIZER: The organizer warrants to Alumni.dbe-du.org, that (i) there is no agreement between the organizer and a venue, or the owner or user of a venue, or a third party, which affects the organizer's use of the Alumni.dbe-du.org-Services in accordance with these terms, (ii) the organizer is allowed to enter into this agreement with Alumni.dbe-du.org, including the right to authorize Alumni.dbe-du.org in accordance to these terms to act as an agent and to sell tickets for events of the organizer.
a.6 DUTIES OF ORGANIZER: The organizer has the duty to inform Alumni.dbe-du.org immediately about unavailability or malfunctions of the Alumni.dbe-du.org-Websites.
The organizer has the obligation to inform Alumni.dbe-du.org immediately about every change of his name, company name, address, legal form or bank details in written form or via E-Mail. The organizer shall not use the Alumni.dbe-du.org-Services for illegal or immoral events such as political or religious extremism, pornographic, or violent events.
The organizer shall not use the Alumni.dbe-du.org-Services to upload, post, email, transmit or otherwise make available any Information that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; The organizer shall not use the Alumni.dbe-du.org-Services to harm minors in any way; The organizer shall not impersonate any person or entity, including, but not limited to, an Alumni.dbe-du.org representative, forum leader, or falsely state or otherwise misrepresent its affiliation with a person or entity; The organizer shall not forge headers or otherwise manipulate identifiers in order to disguise the origin of any Information transmitted through the Service;
a.7 DURATION: Furthermore, Alumni.dbe-du.org has the exclusive right to cancel this agreement regarding the provision of Alumni.dbe-du.org-Services in case of an important reason. In particular such an important reasons shall exist, if the organizer has contravened against important provisions of these terms; or the organizer has filed for bankruptcy, insolvency proceedings have been started or the start of the insolvency proceedings has been dismissed in default of assets; or circumstances occur that the organizer can not fulfill his contractual obligations against Alumni.dbe-du.org or third parties in default of assets, and "in addition" the organizer gives no proof of sufficient assets within 30 days after request by Alumni.dbe-du.org to do so.
a.8 RESTRICTION FOR THE USAGE OF ALUMNI.DBE-DU.ORG SERVICES:
1. that violate any law of the land, statute, ordinance or regulation 2. that relate to transactions involving narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety, drug substance, items such as stolen goods including digital and virtual goods, encouraging, promoting, facilitating orinstructing others to engage in illegal activity, items that promote hate, violence, racial intolerance, or the financial exploitation of a crime, obscene items. 3. that items or digital goods that infringe or violate copyright, trademark, or privacy orright of publicity or proprietary right under the laws of the land. 4. that contain certain sexually oriented materials or services, contrabands, ammunition, firearms, or certain firearm parts or accessories, weapons , knives regulated under the law of the land. 5. that relate to showing personal information of third parties violating the law of the land, supporting pyramid or ponzi schemes, matrix programs, other "get rich quick" schemes or multi-level marketing programs, are associated with purchases of annuities or lottery contracts, gambling products or bills, lay-away systems, off-shore banking or transactions to finance or refinance debts funded by a credit card, are for the sale of certain items before the seller has control or possession of the item, are by payment processors to collect payments on behalf of merchants, are associated with the sale of traveler's checks or money orders, involve currency exchanges or check cashing businesses, provide certain credit repair or debt settlement services, credit transactions or insurance activities. 6. that involve the sales of products or services which are fraudulent. 7. that violate regulations laid down by industry or the state regarding the sale of tobaccoproduct, drugs and devices. 8. that involve gambling or any other venture that facilitates gambling, gaming and activities that requires to pay entry fee and prize such as casino games, sport betting, horse/greyhound racing, games of skill and sweepstakes.
b. BUYERS/PARTICIPANTS TERMS
1. Alumni.dbe-du.org / college / organizer will be organizing the events as specified in the website, Alumni / student can subscribe for the event by filling the form, accepting Terms & condition paying the required fees. 2. Alumni.dbe-du.org reserves the rights of selection or rejection of the application submitted, in case of rejection of application the participant will intimate by email / phone and refund will be initiated within 10 to 15 working days from the date of rejection. Refunds will be issued using the same method of payment that was used to make payment. 3. Once the payment has been made no cancellation will be allowed. 4. No refund will be eligible in case of no show where the participant arrives late or doesnot turn up for the event. 5. Only the registered participant can attend the event / conference & replacement orsubstitution is not allowed. 6. No refunds will be eligible to any individual if the event conducted is not up to thesatisfaction or expectation of the participant. 7. In case event / conference is cancelled or postponed, should this occur, we will attempt to contact you to inform you of the revised dates & if you are unable to attend the event / conference then the amount will be refunded back to you. 8. Events are organized by colleges / organizers, in case of any disputes please directlycoordinate with them. Alma connect will not be responsible for any issue related with events.
9. ALUMNI.DBE-DU.ORG PRIVACY POLICY
Registration Information and certain other information about the User is subject to our Privacy Policy. For moreinformation, see our Privacy Policy.
10. INTELLECTUAL PROPERTY
a. Unless otherwise stated, copyright and all intellectual property rights relating to the Services and the Content presented on Alumni.dbe-du.org (including but not limited to text, audio, video or graphical images posted by the Users), trademarks and logos appearing on therein are the exclusive property of Alumni.dbe-du.org and are protected under the applicable Indian laws. User agrees not to use any trademark or logo or other proprietary information of Alumni.dbe-du.org; or remove, conceal or obliterate any copyright or other proprietary notice or any credit-line or date-line on other mark or source identifier included on the Alumni.dbe-du.org / Service, including without limitation, the size, color, location or style of all proprietary marks. Any infringement shall be vigorously defended and pursued to the fullest extent permitted by law.
b. Alumni.dbe-du.org grants permission to the Users only for accessing and make personal use of the Service and the User agrees not to, directly or indirectly download or modify / alter / change / amend / vary / transform / revise / translate / copy / publish / distribute or otherwise disseminate any Content on Service, or any portion of it; or delete or fail to display any promotional taglines included in the Service, either directly or indirectly, except with the express written consent of Alumni.dbe-du.org. However, the User may print or download extracts from these pages for his/her personal / individual, non-commercial use only. The User must not retain any copies of these pages saved to disk or to any other storage medium except for the purposes of using the same for subsequent viewing purposes or to print extracts for personal / individual use.
c. Alumni.dbe-du.org forbids the User from any attempts to misuse the Service, in contradiction to their payment plan and the applicable laws, including the misuse of any part of the Service and Content, any collection and use of any product listings, descriptions, or prices; any derivative use of the Service provided through Alumni.dbe-du.org or its contents; any downloading or copying of account information for the benefit of any other merchant; any renting, leasing, or otherwise transferring rights to the Service / Content; displaying the name, logo, trademark or other identifier of another person in such a manner as to give the viewer the impression that such other person is a publisher or distributor of the Service, or any data gathering or extraction tools; or any use of meta tags. You may not (whether directly or through the use of any software program) create a database in electronic or structured manual form by regularly or systematically downloading and storing all or any part of the pages from the Alumni.dbe-du.org.
d. No part of the Service may be reproduced or transmitted to or stored in any other web site/mobile application, nor may any of its pages or part thereof be disseminated in any electronic or non-electronic form, nor included in any public or private electronic retrieval system or service without prior written permission from Alumni.dbe-du.org.
11. SUBSCRIPTION FEES AND PAYMENTS
a. Services or part thereof may be made available to the User upon subscription by the User for the same. Even if certain Services are currently being offered by Alumni.dbe-du.org, free of charge, the User agrees and acknowledges that in future the subscription of the Service may carry any subscription fee or charge.
b. Alumni.dbe-du.org reserves the right at any time to increase/decrease/apply/diminish the subscription fee for access to portions of the Services or the Services as a whole. However,in no event will the User be charged for access to the Services unless Alumni.dbe-du.org obtains his/her prior agreement to subscribe to such Service(s).
c.If at any time Alumni.dbe-du.org requires a subscription fee for portions of the Services that are now free, Alumni.dbe-du.org will give the User an advance notice of such fees. Thereafter, the User may cancel his/her account at any time. User shall pay all fees and charges incurred through his/her account at the rates in effect for the billing period in which such fees and charges are incurred, including, but not limited to charges for any digital products or services offered for sale through the Services by Alumni.dbe-du.org or by any other vendor or service provider. All fees and charges shall be billed to and paid by the User. User shall pay all applicable taxes relating to use of the Services through his/her account.
d. Alumni.dbe-du.org reserves the right to change prices and subscription fees at any time. Alumni.dbe-du.org will notify the User in advance if the regular rate of a product/service changes from what was stated at the time of the User’s placing of the order. User will have the opportunity to accept the new price or cancel his/her subscription or purchase from that point forward. If a stated price is erroneously determined by Alumni.dbe-du.org in its sole discretion, Alumni.dbe-du.org will not be under any obligation to offer the product/service at that price to the User. Alumni.dbe-du.org will notify the User of the error within 30 days of his/her order and give him/her the opportunity to cancel his/her order and obtain a refund if payment has already been made.
e. Kindly note that any unused portion of a free trial period, if offered, will be forfeited when the User purchases a subscription to that Service.
f. Additional Costs
(i) If the subscription for certain Service includes access to areas that contain other products/services, the User may have to pay additional fees to fully access those products/services. These additional charges will be clearly stated. (ii) When the User uses the Service, he/she may incur other additional charges, such as telecommunications fees, data fees or service provider fees. User is solely responsible for paying all such charges.
(iii) In the event the User believes that someone else has used his/her account or that he/she is being charged for a product/service he/she did not order/use, please contact Alumni.dbe- du.org at Alumni@dbe-du.org.com
g. Purchase
When the User subscribes to any chargeable Service or purchases a standalone product, Alumni.dbe-du.org will charge or debit his/her payment method at the time of placing of order by the User.
12. LIMITATION OF LIABILITY
a. Alumni.dbe-du.org shall not be liable, at any time for any, direct, indirect, punitive, incidental, special, consequential, indirect, damages (including, without limitation, damages for loss of business projects, damage to the User’s computer system or damages for loss of profits, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of Alumni.dbe-du.org/Services/Content, with the delay or inability touse Alumni.dbe-du.org /Services/Content or related services, the provision of or failure to provide Services, or for any information, software, products, services and related graphics obtained through Alumni.dbe-du.org/Services/Content, or otherwise arising out of the use of the Alumni.dbe-du.org/Services/Content) arising in contract, tort or otherwise from the use of or inability to use the Service, or any of its Content, or from any act or omissions a result of using Alumni.dbe-du.org or any such contents or for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorised access to, alteration of, or use of information contained on Alumni@dbe-du.org.
b. No representations, warranties or guarantees whatsoever are made by Alumni.dbe-du.org as to the (a) accuracy, adequacy, reliability, completeness, suitability or applicability of the information to a particular situation; (b) that the Service will be uninterrupted, timely, secure, or error-free; (c) the quality of any products, Services, Content, information, or other material purchased or obtained from the Service will meet your expectations or requirements; or (d) any errors in the Service will be corrected.
13. CONTACTING THE USER
a. In accordance with clause 4(g), Alumni.dbe-du.org may allow certain third party vendors/service providers to provide the Users with information about their products and services.
b. Alumni.dbe-du.org reserves the right to send electronic mail to the User for the purpose of informing him/her of changes or additions to the Subscription and our Services. For more information please read our Privacy Policy.
c. Alumni.dbe-du.org reserves the right to disclose information about the User’s usage and demographics, provided that it will not reveal the User’s personal identity in connection with the disclosure of such information. Advertisers and/or Licensees on Alumni.dbe-du.org may collect and share personal information about the User only if he/she indicates his/her acceptance. 14. TERMINATION
a. Alumni.dbe-du.org may, in its sole discretion, terminate or suspend the User’s access to all or part of the Services for any reason, including, without limitation, breach or assignment of these Terms of Service. Alumni.dbe-du.org reserves the right to block IPs from accessing its server(s).
15. MISCELLANEOUS
a. These Terms of Service have been made in and shall be construed and enforced in accordance with Indian laws. User irrevocably agrees that the courts at New Delhi in India shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms of Service or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the India courts.
b. For the exclusive benefit of Alumni.dbe-du.org, Alumni.dbe-du.org shall also retain the right to bring proceedings as to the substance of the matter in the courts of the country/Stateof the User’s residence or, where these Terms of Service are entered into in the course of his/her trade or profession, the country of his/her principal place of business. In the event the User identifies or suspects any adverse effect to the Services/Content/Intellectual Property, he/she should immediately contact us on Alumni@dbe-du.org.com
c. All correspondence should be sent to our registered address mentioned on our contact us page.
d. User agrees to report any violations of the Terms of Use to Alumni.dbe-du.org as soon as he/she becomes aware of them. In the event he/she has a claim of infringement with respect to material that is contained on Service, he/she should notify Alumni.dbe-du.org on alumni@dbe-du.org.com
e. Assignment & Delegation
No right may be assigned, and no duty may be delegated, by the User under this Agreement except upon the written consent of Alumni.dbe-du.org and any attempted assignment and delegation without such consent shall be void and without effect. Notwithstanding the foregoing, however, Alumni.dbe-du.org shall be entitled to assign these Terms of Service, and all rights and obligations hereunder, to a successor to all or substantially all of its assets, whether by sale, merger or otherwise. These Terms of Service shall be binding upon and shall inure to the benefit of the parties hereto and their respective representatives, heirs, administrators, successors and permitted assigns except as otherwise provided herein.
f. Agency Neither party is, nor will it be deemed to be, an agent or legal representative of the other party for any purpose. Neither party will be entitled to enter into any contracts in the name of or on behalf of the other party, and neither party will be entitled to pledge the credit of the other party in any way or hold itself out as having authority to do so.
g. Severability If any provision(s) of the Terms of Service is/are held by a court of competent jurisdiction to be contrary to law, or otherwise invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.
h. Waiver Any waiver (express or implied) by either party of any breach of these Terms of Service shall not constitute a waiver of any other or subsequent breach. No provision of the Terms of Service will be waived by any act, omission or knowledge of a party or its agents or employees except by an instrument in writing expresslywaiving such provision and signed by a duly authorized officer of the waiving party.
i. Policy for Posting Comments Adhering to the cyber crime requirements, we are now capturing the IP of those posting comments. This is to keep a check on those using abusive and offensive language. By capturing the IP, the cyber crime department can not only track date, time, network of the offender, but also the computer from which it is posted.
